Laws + Regulations
Graduated Driver’s License Law
New rules regarding the Graduated Driver's License (GDL) took effect on January 1, 2015. Below is a brief summery of the changes.
All students (under age 18) will be required to submit a Supervised Driving Log to the examiner at the time of their road test. This log must contain 50 hours of practice driving time (15 hours at night) and must be signed by a parent/guardian. The log may contain 40 hours of practice driving (15 hours at night) IF the student's parent attends a Parent's Meeting. The person signing the driving log form is considered to have supervised the majority of the student's practice driving hours. Student's must submit the state approved driving log which can be obtained at our office.
All driver training programs are now required to offer a parent course. The parent course is optional. If the parent chooses to attend, 40 hours (15 at night) will be required on the driving log rather than 50 hours (15 at night).
A certificate of attendance will be issued to parent's who wish to attend a meeting. This certificate along with the driving log will be submitted to the Exam Station at the time of the student's road test.
Vanessa’s Law
An unlicensed teen who received a crash-related moving violation or an alcohol/controlled substance-related violation (a violation of one or more statutes, including DWI, Implied Consent, Open Bottle, or Underage Drinking and Driving/Not a Drop Law) cannot be given a license, including an instruction permit or provisional license, until age 18. When this person turns 18, she/he must pass the driver's license knowledge test, obtain an instruction permit and hold it for at least six months, and then pass the road test.
A provisional license holder whose driving privilege was revoked due to a crash-related moving violation or an alcohol/controlled substance-related violation cannot regain a license until age 18. At that time, the person must complete the following steps to obtain a full driver's license:
-Fulfill all reinstatement requirements, including the payment of fees which can be up tp $700 depending on circumstances
-Complete the 30 hour classroom portion of a formal driver education course
-Pass the driver's license knowledge test
-Obtain an instruction permit and hold it for three months
-Complete driver's behind-the-wheel classes
Teen Passenger Limitation
Effective 8-01-08
For the first six months of licensure: Only one passenger under the age of 20 is permitted, unless accompanied by a parent or guardian.
For the second six months of licensure: No more than three passengers under the age of 20 are permitted unless accompanied by a parent or guardian.
Exemption: Passengers under age 20 who are members of the immediate family are permitted.
These provisions also apply to teens licensed before 08-01-08. For example, a teen licensed on July 1 has five months and a subsequent six months of limitation requirements, rather than starting the limitation time periods anew on 08-01-08.
Nighttime Driving Limitations
Effective 8-01-08
For the first six months of licensure: Driving is prohibited midnight - 5:00 AM
Exemptions: Driving when accompanied by a licensed driver age 25 or older; driving between home and place of employment; driving to/from home and a school event for which the school has not provided transportation; driving for employment purposes.
The nighttime limitation is lifted after the first six months of licensure.
Cell Phone & Texting Restrictions
It is illegal for drivers under age 18 to use a cell/wireless phone, whether hand-held or hands-free ~ except to call 911 in an emergency. A new law has made it illegal for drivers of all ages to compose, read, or send text messages or access the internet on a wireless device while on the road.
Drinking & Driving
It is illegal for a person under age 21 to drive after consuming any amount of alcohol. Consequences for underage drinking and driving are loss of license for at least 30 days and court fines.
Teen drivers with a provisional license whose driving privileges are revoked from a crash or alcohol/controlled substance-related violation cannot regain a license until age 18.
Seat Belt Use
By MN law, all drivers and passengers must wear a seat belt or be properly secured in a child restraint.
